Germany Adds Quantum Computers to National Export Control List

On July 23, 2024, the 21st ordinance amending the German Foreign Trade and Payments Ordinance (Außenwirtschaftsverordnung, AWV) entered into force. The amendments added quantum computers, parametric signal amplifiers, cryogenic refrigeration units, and other emerging technologies to Section B of the national Export List, subjecting them to export authorization requirements, according to an analysis by Noerr.

Exports of listed items to destinations outside the EU customs territory and outside countries listed in the Dual-Use Regulation (including Australia, Canada, Japan, the United Kingdom, and the United States) now require authorization from the Federal Office for Economic Affairs and Export Control (BAFA). Transfers within the EU are also subject to authorization if the shipper is aware the final destination lies outside the EU.

Germany was subsequently recognized by the U.S. Bureau of Industry and Security as a country with implemented equivalent controls under the new License Exception IEC framework announced in September 2024.
