New Zealand Introduces Catch-All Military End-Use Export Controls Covering Dual-Use Technologies

In October 2020, New Zealand introduced catch-all export controls through a Gazette notice issued under the Customs and Excise Act 2018. The new provisions regulate the export of items not listed on the New Zealand Strategic Goods List (NZSGL) but which may be intended for military or police use, or which may have military applications.

According to the Ministry of Foreign Affairs and Trade, the catch-all controls carry over existing prohibitions on exports related to weapons of mass destruction and their means of delivery. They also establish a new prohibition on items intended for use in terrorist acts and extend military end-use controls to items that materially enable or support military or internal security operations.

Unlike the NZSGL, which lists specific controlled items derived from four international export control regimes to which New Zealand belongs, the catch-all provisions apply to all countries and all products regardless of whether they appear on the strategic goods list. Exporters are required to notify the Secretary of Foreign Affairs and Trade if they are aware, or should reasonably be aware, that an export is intended for a prohibited use.
